Payment and Deposit
We require a non-refundable booking payment of 50% of the total price to confirm an order and hold the date. The remaining 50% is due 2 weeks before the delivery date, at which point all changes must be confirmed (changes to the previously agreed design may incur extra fees). Orders placed less than 2 weeks in advance of the delivery date must be paid in full. The final balance specified on the invoice must be paid by the Buyer 2 weeks before the delivery date. Payment can be made earlier if you wish. Failure to complete payment 2 weeks before the delivery date may result in your order being cancelled. By making a payment the Buyer is accepting the Terms and Conditions as detailed on this page.
Sketches
All sketches supplied for the client are done so in good faith, they remain the property of Let Them Eat Cakes and are subject to copyright and should not be replicated or reproduced.
Changes
Reasonable changes to your order may be made up to 3 weeks before the event. Additional costs may be incurred depending on the nature of the changes. Minimums still apply. If we are able, we will accommodate any changes you request including, but not limited to flavours, shapes, and decorations. If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration, and endeavour to alter where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than 6 weeks before completion may be subject to a surcharge. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.
Allergies and Dietary Requirements
Please discuss any allergies or special dietary requirements with us before making payment. We offer various dietary options, however, our products are not suitable for those with severe allergies as our kitchen handles wheat and nuts. Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions. Let Them Eat Cakes is not responsible for any allergic reactions
Cancellation Policy - If you notify us of a cancellation at least 90 days before the event, we will refund half of your booking payment. No refunds of the deposit will be given after that date, however, we appreciate you giving as much notice as possible and if we can re-book your date, we will apply half of the amount of your unrefunded booking payment to a future event.
Covid 19 - should you need to postpone your event due to Covid 19 we will endeavour to accommodate your new date. If we are unable to accommodate your new date then we will refund any money paid to us thus far. Likewise if we need to close our bakery due to Covid 19 then we will refund any money paid to us thus far. If you are wishing to cancel your booking with no postponed future date then our normal cancellation policy above will apply.
Our Obligation
We take our obligation to provide your wedding cake as agreed in this contract very seriously. However, should an unforeseeable event occur which prevents us from fulfilling our obligation and we must cancel our agreement with you, we will refund your payment-in-full. Also, if at all possible we will work with you to find another qualified bakery to assist you with your wedding cake and will cooperate in transferring materials to the new baker.
Accidents/Weather/Force Majeure - While we take our responsibilities very seriously, there may be some extreme conditions, such as accidents or inclement weather, which may prevent us from fulfilling our obligation. Please keep your contact information and alternate contacts up to date so that we may notify you of any situation that may have occurred or may be anticipated.
Delivery and Collection
Our bakery will not be responsible for damages to your cake once it leaves our facility. If you or your representative elect to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves our possession. If you are managing the delivery yourself, we recommend the cake be placed on a flat surface in your vehicle rather than the boot or angled seats. Placing a non-slip mat on the surface where the cake will be placed may help prevent sliding. Remember, the speed you go is not so much the issue, braking and taking the corners at that speed is. Never have someone hold the cake in his/her lap. Please keep the cake cool and away from the sun to prevent softening and melting. This is the responsibility of the Buyer.
Delivery and setup is at a rate of £1.55 a mile per round trip (for weddings and large events these charges are part or wholly included in the quoted price)
Delivery will normally be scheduled for about 2 hours before the reception. We will always endeavour to deliver within the given time slot, however, unfortunately, delivery timings cannot be guaranteed. If in the unlikely event the delivery is delayed, we will always endeavour to deliver the cake to you as close as possible to the given delivery time. In the unlikely event of late delivery (defined as the delivery after the start of the wedding breakfast), the maximum compensation will be 10% of the cost of the cake. We ask for patience with factors that may be beyond our control, (e.g. traffic conditions) as we cannot be held liable for any such delays.
Variations and substitutions
While we make every effort to provide exactly the flavours, fillings, decorations, sizes, shapes and colours you have requested, the creation of a wedding cake is an art and may be subject to slight variations on the agreed design. Given the nature of the goods, minor variations of colour and design may apply. On occasion we may need to substitute your sweet choice (on sweet and dessert tables) for a similar product.
Photographs of Your Cake
We reserve the right to take and use our photos of your cake(s) to use for marketing and promotional purposes, including advertising and promotion through our marketing partners, without compensation to you. We may also request photographs from your photographer for the same purpose again without compensation to you, though we may be able to credit the photographer in some marketing if agreed by us and the photographer.
Product Information
The images on the website are examples of our cakes. All our products are hand-made and can be ordered in different sizes from those shown on the website, your cake may have variations from the website image.
Best Before
Your cake is baked to ensure it is fresh for the date of your wedding or event. We cannot guarantee its quality if it is consumed more than 48 hours after the event. Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat. Cake intended to be consumed after the event should also be wrapped to prevent it from becoming dry. Iced cakes should NOT be refrigerated.
Non-Edible Cake Decorations
Our Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires and polystyrene cores in some sugar flowers. If flowers are provided by an outside source, you acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt or other contaminants. You assume liability for checking the flowers used are not a poisonous variety.
Cake Table Setup
The table for the cake should be sturdy and level to support at least 75 pounds. The size for a round table should be at least 36 inches in diameter and a standard 30 inches high. A square table or the shortest side of a rectangular table or must be a minimum of 36 inches. Upon delivery and after the set up is complete, the care and protection of the cake become your responsibility. The table should be very visible, but not in a high traffic area where it could get bumped before being cut and served. Make sure you have chosen a protected area that is level and stable, where the cake will not be overly exposed to the weather or elements, and not too close to the dance floor. We are not responsible for any damage to the cake after setup is complete. You are responsible for providing an appropriate and secure table and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 23 degrees C or below.
Cake Tip: Much of the reception and many of the reception photos take place in and around the cake. To make the most of the moment as well as your lasting memories, we would like to make the following suggestions. The cake should be placed on its table, with a coordinating or complementing table cloth (pressed, clean and crisp), plants and flowers may be arranged on the table as appropriate. Candles can also add a special touch. For photos, a white or light coloured cake may stand out better on with a darker background vs. a white painted wall. If there is a window behind the cake, the lighting for the photos may need to be adjusted. Also watch for unattractive elements that may be in the background of your photos such as a vent, pipes, electric cords, fire alarm, toilets, and other doors, etc. Generally, take a look at your reception site in advance to find the ideal place to set up the cake table.
Cake Toppers and Ornaments
If you are providing your cake topper or ornament, you may bring the item to us up to two weeks in advance, (or have the suppliers send directly to us at our address, or leave with your co-ordinator at the venue, clearly marked or our attention). The item should be brought to us at least 2 weeks in advance. We will make every effort to incorporate the topper or ornament and secure it to the cake; however, we are unable to accept responsibility for the replacement cost if the ornament is lost or broken.
Deposits for rental or loaned equipment
We require a deposit on all rental or loaned equipment. The deposit amount is listed in the agreement. If the equipment is returned in good condition within 5 days after the event, your deposit will be refunded. If your cake or cakes require a stand, and in the case of sweet tables with glassware, a security deposit must be left with us at the time of final payment in order to ensure safe return of the equipment. We will return this security deposit when the equipment is returned to us in original condition no later than one week past the event date. The security deposit is forfeit if equipment is not returned by agreed ‘Equipment Return Date’.
Broken or missing parts/replacement costs
If you have chosen to keep the equipment or return it with missing or broken parts, you will be responsible for the replacement cost of the equipment. We will hold your deposit and charge your credit card or bill you for the additional charges.
Let Them Eat Cakes assumes no liability for the sweets jars or cake stands if they are broken while they are on loan. Caution should be used, especially if children are present at the event. Broken glassware should be dealt with immediately by a responsible adult - Let Them Eat Cakes assumes no liability. All sweets are outsourced to bulk and wholesalers, nothing is made by Let Them Eat Cakes, because of this we cannot guarantee the ingredients used in all sweets. It is your responsibility to inform the guests who may have allergies that the buffet is not nut-free or gluten free and may have come in contact with nuts.
Colour matching
We will make every effort to match swatches of material or other colour examples you provide as closely as possible, however, some colours simply cannot be recreated in icing and may not be a perfect match.
Complaints
In the highly unlikely event you have cause to complain, you or your chosen representative must call us immediately to see if the problem can be rectified and the cake must be returned for inspection within 24 hours of collection or delivery. Once this time has lapsed it is deemed that everything was satisfactory with your cake and there were no complaints. If more than a couple of servings of the cake has been eaten we cannot accept any complaint. Full refunds will never be given for any cake which has been consumed, regardless of the dispute, as the consumption of the cake is viewed as your acceptance that the cake was adequate for the purpose for which is has been supplied. We do not accept any responsibility for loss or damage to the cake, decorations and stands once the cake has been delivered to the venue or collected from our premises. All refunds are made at our discretion and any refund will be limited to the cost of the cake, no further compensation will be awarded.
